Board Policy CL-1: how Georgia measures 250 sq ft

The Board counts every interior area connected to your office that you can access and use, not just the room with your desk. The full text is below.

What counts toward the 250 sq ft

The policy names these areas and says the list is not limited to them:

  • Conference rooms
  • Internal hallways
  • Restrooms
  • Breakrooms
  • Storage areas

The Board applies it to dealer locations proposed on or after January 1, 2026.

Purpose: The Board policy below is to clarify the method of assessing and calculating the interior space in relation to the square footage requirements for a Used Motor Vehicle Dealer and a Used Motor Vehicle Parts Dealer as established in O.C.G.A.§ 43-47-2(3) and O.C.G.A. §43-47-6(7).

Pursuant to the authority granted to the Board in O.C.G.A. § 43-47-6(7), on or after January 1, 2026, the Board shall use this policy to determine if the location proposed by a Used Motor Vehicle Dealer and/or Used Motor Vehicle Parts Dealer meets the requirements for an “established place of business” as that term is defined in O.C.G.A. § 43-47-2(3). Specifically, when calculating the square footage of a proposed location to determine if the two hundred fifty (250) minimum square footage requirement contained in O.C.G.A. § 43-47-3(2) has been met, the Board shall include in the calculation of the square footage of a proposed location all interior areas functionally connected to the established place of business to which the Used Motor Vehicle Dealer and/or Used Motor Vehicle Parts Dealer has access and use. Such interior areas functionally connected to the established place of business may include, but are not limited to, conference rooms, internal hallways, restrooms, breakrooms, and storage areas.
